Terms of Service
Blurred Xposure, Inc.
By booking a session, purchasing products, downloading digital images, or using any services provided by Blurred Xposure, Inc. ("BXI"), you agree to the following Terms of Service.
Booking & Payment
A signed agreement and/or payment of a retainer may be required to reserve a session or event date. Dates are not guaranteed until the required payment has been received. Remaining balances are due according to the terms outlined in the applicable service agreement or invoice.
Rescheduling & Cancellations
Clients who need to reschedule should provide as much notice as possible. Rescheduling requests are subject to availability. Retainers and reservation fees are non-refundable unless otherwise stated in writing.
BXI reserves the right to reschedule services due to severe weather, equipment failure, illness, emergency, venue restrictions, or circumstances beyond our reasonable control.
Client Responsibilities
Clients are responsible for:
Arriving on time for scheduled sessions.
Obtaining any necessary permissions, permits, or approvals for photography locations when required.
Providing accurate information regarding event schedules, locations, and contact details.
Ensuring the safety and cooperation of all participants during the session.
BXI is not responsible for missed images resulting from late arrivals, schedule changes, restricted access, or lack of cooperation by participants or venue staff.
Artistic Discretion
Clients acknowledge that they have reviewed BXI's portfolio and understand that photography and videography involve artistic judgment. Image selection, editing style, composition, color treatment, and final delivery are performed at the sole discretion of BXI.
Image Delivery
Delivery timelines may vary based on the type and scope of services provided. Final images and videos will be delivered in a format determined by BXI. Raw, unedited files are not included unless specifically agreed upon in writing.
Copyright & Licensing
All photographs, videos, and related creative works remain the exclusive property of Blurred Xposure, Inc. and/or Marcus S. Boyd, Sr. Clients receive usage rights as outlined in their service agreement and applicable licensing terms. No copyright ownership is transferred unless expressly stated in writing.
Print & Product Orders
All print products, albums, wall art, digital downloads, and custom products are subject to the Refund & Rescheduling Policy and Digital Image License. Due to the custom nature of photographic products, all sales are final unless a manufacturing defect is verified.
Limitation of Liability
In the unlikely event of equipment malfunction, loss of data, acts of God, venue restrictions, illness, injury, or other circumstances beyond BXI's control, liability shall be limited to the amount paid by the Client for the affected services.
BXI shall not be liable for indirect, incidental, consequential, or special damages arising from the use of its services or products.
Website & Online Galleries
Clients are responsible for safeguarding gallery access links, passwords, and downloaded files. BXI is not responsible for unauthorized access resulting from the sharing of gallery credentials by the Client.
Privacy
BXI respects client privacy and will not sell personal information to third parties. Client information is used solely for business operations, communication, service fulfillment, marketing communications (when authorized), and legal compliance.
Acceptance of Terms
By booking services, making a purchase, accessing an online gallery, downloading digital files, or otherwise engaging with Blurred Xposure, Inc., you acknowledge that you have read, understood, and agree to these Terms of Service.
